Independence Day Real Estate Law HB 679
ECAR Closed Independence Day

Transaction Broker Disclosure Obligation Expires

The obligation to provide a transaction broker notice to a customer involved in a residential sale (as defined in Section 475.278(5), Florida Statutes) is no longer required. This obligation, set forth as part of the real estate license law’s “presumption of transaction brokerage” in 2003, expired July 1, 2008. Crist Kills HOA Disclosure Bill, Form Won't Change

If you've been following the progress of HB 679 in EarlyBird, FAR has learned that Gov. Charlie Crist vetoed the bill.

Do not make any changes to the Homeowner's Association/Community Disclosure form. Florida real estate licensees should continue to use the disclosure language already included in current residential contracts.
DBPR Reforms, Other Laws Start July 1

The following bills - passed during the 2008 session of the Florida Legislature and signed by Gov. Charlie Crist - become effective on Tuesday, July 1:
• SB 464: Prohibits private transfer fees
• HB 601: Reforms to the Department of Business and Professional Regulations
• HB 743: Mortgage fraud regulations
• SB 2860: Property insurance reforms

ROC to Collect School Supplies at Member Breakfast

Helping over 700 area school children in need of supplies, the Emerald Coast Association of REALTORS® Realtor Outreach Committee (ROC) will be collecting school supplies at the ECAR Membership Breakfast July 25. Members are asked to bring pens, pencils, erasers, binders, folders, and many other items needed by kids. A complete list of needed items is available on the ROC Backpack 2 School Drive flyer. Members not attending the breakfast may contact ROC Chair Lisa Norton to donate supplies.
