Independence Day Real Estate Law HB 679
ECAR Closed Independence Day

ECAR will be closing at 2:00 p.m. Thursday, July 3, 2008, and will be closed Friday, July 4 for Independence Day. Emergency MLS/Supra support is always available by calling 850-244-2411.

Transaction Broker Disclosure Obligation Expires

The obligation to provide a transaction broker notice to a customer involved in a residential sale (as defined in Section 475.278(5), Florida Statutes) is no longer required. This obligation, set forth as part of the real estate license law’s “presumption of transaction brokerage” in 2003, expired July 1, 2008. Crist Kills HOA Disclosure Bill, Form Won't Change

If you've been following the progress of HB 679 in EarlyBird, FAR has learned that Gov. Charlie Crist vetoed the bill.

Do not make any changes to the Homeowner's Association/Community Disclosure form. Florida real estate licensees should continue to use the disclosure language already included in current residential contracts.
DBPR Reforms, Other Laws Start July 1

The following bills - passed during the 2008 session of the Florida Legislature and signed by Gov. Charlie Crist - become effective on Tuesday, July 1:
• SB 464: Prohibits private transfer fees
• HB 601: Reforms to the Department of Business and Professional Regulations
• HB 743: Mortgage fraud regulations
• SB 2860: Property insurance reforms

NAR Restates 2008 Nondeductable Dues
NAR has restated nondeductible dues dollars for 2008 because of the significant amount of new programming added to NAR’s 2008 budget. The 2008 nondeductible amount has been increased to $25, or 31 percent of dues, from $18, or 22 percent of dues. For 2009, $26 of the $80 in dues per member will be nondeductible. ROC to Collect School Supplies at Member Breakfast

Helping over 700 area school children in need of supplies, the Emerald Coast Association of REALTORS® Realtor Outreach Committee (ROC) will be collecting school supplies at the ECAR Membership Breakfast July 25. Members are asked to bring pens, pencils, erasers, binders, folders, and many other items needed by kids. A complete list of needed items is available on the ROC Backpack 2 School Drive flyer. Members not attending the breakfast may contact ROC Chair Lisa Norton to donate supplies.

Have your cake, and eat breakfast too! A fun and informative ECAR Membership Breakfast is planned for Friday, July 25, 2008, at the Sandestin Hilton. Okaloosa County Property Appraiser Pete Smith will be the featured guest and will be discussing what property owners should expect as a result of passage of Amendment One in January. ECAR’s Realtor Outreach Committee will be auctioning desserts in its effort to support local organizations and charities. ROC is also asking members to bring school supplies to help needy children prepare for the new school year.  The meeting will begin at 8:30 a.m. Members may sign up online, or they may contact Paula Bailey at ECAR (850-243-6145). The cost to attend will be $7.50.
Candidates Sought for Open Positions on 2009 BOD

In a year full of elections, ECAR members may want to consider jumping on the bandwagon and applying to run for one of the positions opening up next year on the Board of Directors. Applications are being accepted through August 10 for the following positions:

At-large Directors (three positions)

To apply, click on the name of the position above, fill out the application, attach a photo, and submit the application electronically or by printing it. A description of the position and complete instructions are included in the application. Voting will being in September and the winners will be announced at the Annual Membership Meeting on October 10.

New MLS Pricing for Non-ECAR Members Starts July 1

MLS fees for non-ECAR members will increase beginning July 1, 2008. Realtors belonging to other associations who use ECAR’s Multiple Listing Service will be charged $50 a month per subscriber; non-Realtors using the MLS will be charged $75 a month per subscriber. MLS fees for ECAR members will remain at $25.  Membership applications for brokers and salespeople are available here.

Deadline July 31 for FAR Committee Sign Up
Requests to serve on a 2009 FAR committee, council, forum or exchange are being accepted through July 31. In year's past, members could register at the annual FAR convention and trade expo; but starting this year, the forms can be accessed only from floridarealtors.org. All requests submitted through the online registration form (login required) can be found at:
